Twitter Account - SilverAlert

On October 7, 2009, we contacted Timothy Holmgren of Elopement Solutions, L.L.C . / www.missingpatient.com via USPS Certified Mail and asked him to cease and desist in any further use of our trademarked name, Silver Alert®, in association with marketing, sale, distribution, or identification of his products and services.

On October 13, 2009, we contacted Mr. Holmgren again, via email and asked that he refrain from using our trademarked name, Silver Alert® as his Twitter account.

It was our intention to settle this without involving Twitter, until we received Mr. Holmgren’s reply via email on October 29, 2009, which stated the following:

“I’m afraid that you’ll have to speak with Twitter as I feel this doesn’t infringe on any Trademarks.”

We did as requested and contacted Twitter, presented our trademark information, and they deemed that Mr. Holmgren was indeed infringing on our trademark and canceled his Twitter account.

As for the accusations of our company disguising itself as the U.S. Government’s proposed Silver Alert Act, as clearly stated on our website, we have no association with the U.S. Government whatsoever.

Thank you for the opportunity to clear up any misunderstandings you may have regarding this situation.

The National Silver Alert Program

Time is of the essence when individuals with Alzheimer's or other cognitive disorders wander off or become lost.

Approximately 50% of those who wander away may suffer serious injury or death if not found within 24 hours.

The National Silver Alert Program was developed to provide vital information to authorities to assist in the search and safe recovery of these individuals, and quickly reunite them with their loved ones and/or caregivers.

The free, online registration program records vital health, personal, medical and caregiver information, as well as a photograph of each registered individual.

This information is stored in a secure, online database, where it can be accessed by emergency responders via the National Silver Alert call center's toll-free, emergency phone number.

This program is open to ALL senior citizens and individuals with Alzheimer's or other cognitive disorders, regardless of age, who wish to have their vital health, personal, medical and caregiver information readily available in the event of an emergency.

Silver Alert - The Amber Alert for Seniors

Modeled after the Amber Alert, the Silver Alert is an emergency system in which law enforcement can broadcast regional or statewide alerts for missing seniors and/or other adults with Alzheimer's or other cognitive disorders.

A growing number of states are enacting laws that call for the development of the Silver Alert program and some have implemented their own notification systems.

In April, 2008, U.S. Rep. Gus M. Bilirakis (R-FL), introduced legislation that would establish a national grant program to help U.S. States and territories establish Silver Alert notification systems to locate missing individuals suffering from dementia related illnesses.

November is National Alzheimer's Awareness Month

According to the National Institute of Mental Health:

AD affects an estimated 4.5 million Americans.

The number of Americans with AD has more than doubled since 1980.

AD is the most common cause of dementia among people age 65 and older.

Increasing age is the greatest risk factor for Alzheimer’s. In most people with AD, symptoms first appear after age 65. One in 10 individuals over 65 and nearly half of those over 85 are affected. Rare, inherited forms of Alzheimer’s disease can strike individuals as early as their 30s and 40s.

From the time of diagnosis, people with AD survive about half as long as those of similar age without dementia.
